These terms are the agreement between you and Nancy Sahu for the use of IsItStillUp. Please read them before you create an account or buy a subscription — by doing either, you accept them.

1. Who we are

IsItStillUp (the “Service”) is operated by Nancy Sahu, whose registered address is Bengaluru, Karnataka, India (“we”, “us”, “our”). The Service is provided at https://www.isitstillup.com and at any custom domain you connect to it.

In these terms, “you” and “Customer” mean the individual or organisation that holds an IsItStillUp account. “End Users” means the visitors and subscribers of the status pages you publish with the Service.

2. Acceptance of these terms

By creating an account, signing in, publishing a status page or purchasing a subscription, you confirm that you have read and agree to these terms and to our Privacy Policy and Refund Policy, which form part of this agreement. If you do not agree, do not use the Service.

You confirm that you are at least 16 years old and legally able to enter into this agreement. If you accept these terms on behalf of a company or other organisation, you confirm that you have authority to bind that organisation, and “you” refers to it.

3. What the Service does

IsItStillUp is a hosted status-page platform. A subscription gives you access to:

  • Public status pages — pages you configure (components, incidents, scheduled maintenance, uptime history) which we render as static pages and serve on an IsItStillUp subdomain or on a custom domain you verify.
  • Monitoring — HTTP, keyword, TLS-expiry and cron heartbeat checks that we run against endpoints you nominate, at the interval your plan allows, and which can open and update incidents automatically.
  • Notifications — email, and on eligible plans SMS, Slack, Microsoft Teams, Discord and webhook delivery to the subscribers and channels you or your End Users have configured.
  • APIs and integrations — a REST API, an MCP server, RSS feeds, status badges and data exports, subject to the rate limits published for your plan.
  • AI assistance — optional, approve-first drafting of incident updates and postmortems. Nothing drafted by these features is published without a human in your organisation submitting it.

We improve the Service continuously. We may add, change or remove features, but we will not materially reduce the core functionality of a paid plan during a billing period you have already paid for without offering you a pro-rata refund of the unused portion.

4. Your account

IsItStillUp does not use passwords. You sign in with a one-time link sent to your email address, or through your organisation’s SAML single sign-on where that is configured. This makes your email inbox the key to your account: keep it secure, and tell us immediately at support@isitstillup.com if you believe it has been compromised.

You are responsible for everything done under your account and by the members you invite to your organisation, including their compliance with these terms. Organisation owners control roles and access, and are responsible for removing members who should no longer have it. Account information you give us must be accurate and kept up to date.

API keys and webhook signing secrets are credentials. Store them as such, rotate them when a holder leaves, and never embed them in a public status page, a client-side script or a public repository.

5. Acceptable use

You agree not to use the Service, and not to allow anyone else to use it, to:

  • publish a page that impersonates another company, product, brand or person, or that is designed to phish, deceive or harvest credentials from visitors;
  • host, link to or distribute unlawful, infringing, defamatory, obscene or harassing content, malware, or content that violates anyone’s privacy or intellectual property;
  • monitor endpoints you do not own or are not authorised to test, or use monitors to load-test, scan, enumerate or attack any system;
  • send unsolicited messages: subscribers must have opted in, and imported subscriber lists must consist of people who agreed to receive status notifications from you;
  • exceed, circumvent or automate around the limits of your plan (page, monitor, subscriber, AI action and API rate limits), or resell, sublicense or white-label the Service as your own status-page product without a written agreement with us;
  • interfere with the Service’s operation or security, attempt to access another customer’s data, or probe or reverse-engineer the platform outside the scope of our published security disclosure policy.

Monitoring is subject to fair use. Checks must target endpoints designed to answer them, at a rate that a reasonable operator would consider ordinary monitoring traffic. We may throttle or disable a monitor that is degrading a third party’s systems or ours.

We may remove content or suspend a page that breaches this clause, and we will tell you why. Where a breach is serious — phishing, malware, an active attack — we may act immediately and notify you afterwards.

6. Plans, prices and subscriptions

The Service is offered on the plans below. Prices are in US dollars per organisation per month and exclude any sales tax, VAT or GST, which is calculated and added at checkout.

The published plan limits are the contractual limits. Where you have agreed a different set of limits with us in writing, those apply to your organisation instead.

6.1 Auto-renewal

Paid plans are subscriptions. They renew automatically at the end of each billing period at the then-current price for your plan, using the payment method on file, until you cancel. You can cancel at any time (see clause 8).

6.2 Price changes

We may change prices. We will give you at least 30 days’ notice by email before a change takes effect for your subscription, and the new price applies from your next renewal after that notice period. If you don’t want to pay the new price, cancel before that renewal.

6.3 Failed payments

If a renewal payment fails, Paddle will retry it and notify you. If payment is not completed after those retries, your organisation is downgraded to the Free plan and any usage above the Free limits stops — your data is not deleted at that point (see clause 16).

6.4 Taxes

Prices exclude tax. Paddle determines, collects and remits the sales tax, VAT or GST due on your purchase based on your billing country and any tax identifiers you provide at checkout. Business customers can enter a valid VAT/GST number at checkout to be handled under the applicable reverse-charge rules.

7. Payment processing — Paddle is our Merchant of Record

Our order process is conducted by our online reseller and Merchant of Record, Paddle.com Market Ltd (and, depending on your location, its affiliate Paddle Payments Limited) (together, “Paddle”). Paddle is the seller of record for every order placed through the Service. Paddle handles the checkout, payment processing, tax calculation and remittance, invoicing, subscription billing and refunds.

This means that when you buy a subscription, in addition to these terms you also enter into a contract with Paddle on Paddle’s Checkout Buyer Terms, and Paddle’s Privacy Policy applies to the personal data you give them. Your invoice and card statement will show Paddle, not us.

We never see or store your full card number, bank details or any other payment credentials — they are entered on Paddle’s hosted checkout and held by Paddle. We receive only the identifiers, subscription status and transaction records we need to provision your plan and to answer your billing questions.

Billing enquiries can go either to Paddle’s buyer support or to us at support@isitstillup.com; where a refund or chargeback needs to be actioned on the payment itself, Paddle performs it.

8. Free plan, upgrades, downgrades and cancellation

The Free plan is available indefinitely, at the limits published above, without a payment method. We may change or discontinue the Free plan on 30 days’ notice.

Upgrades take effect immediately; Paddle charges the new plan and applies a pro-rata credit for the unused remainder of your current period.

Downgrades and cancellation are self-serve from the billing page in your dashboard and take effect at the end of the period you have already paid for. You keep the features of your current plan until then; after that, your organisation moves to the lower plan (or to Free) and its limits apply. Anything you have created above the new limits — extra pages, monitors, subscribers — stops being served or checked rather than being deleted, so an upgrade restores it.

Cancelling stops future renewals. It is not, by itself, a request for a refund of an amount already charged — see the Refund Policy, which sets out a 14-day money-back guarantee on a first subscription purchase and how to request it.

9. Your content

You own your content. Everything you put into the Service — your organisation and page names, logos and branding, component names, incident titles and updates, maintenance notices, postmortems, custom domains, monitor configuration and your subscriber lists (together, “Customer Content”) — remains yours. We claim no ownership of it.

You grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, transmit, render, translate, index and display Customer Content, and to send it to the End Users and channels you direct, for the sole purpose of operating and supporting the Service for you. The licence lasts as long as we hold the content and ends when it is deleted. We do not sell Customer Content, and we do not use it to train general-purpose AI models.

You are responsible for Customer Content: that you have the rights to publish it, that it is accurate, and that it does not breach clause 5. Remember that a public status page is public — do not put personal data, customer names, credentials, internal hostnames or security-sensitive detail into an incident update you intend to publish.

10. Subscriber data and data protection

Two different kinds of personal data pass through the Service, and our role differs for each.

  • For your account data — the names and email addresses of the people in your organisation, billing records, audit logs — we are the controller.
  • For the personal data of your End Users — the email addresses and phone numbers on your page’s subscriber list, and anything personal you choose to publish in your own content — you are the controller and we act as your processor.

As processor we will: process End User data only on your documented instructions (your use of the Service being those instructions); keep it confidential and bound by confidentiality obligations on our staff; apply the security measures described in our Privacy Policy; use only the subprocessors listed there and give you notice before adding another; assist you with End User rights requests, breach notification and impact assessments; and delete or return the data at the end of the agreement. This clause, together with the Privacy Policy, is our data processing agreement with you.

You are responsible for having a lawful basis to add someone to a subscriber list, for honouring their unsubscribe requests (the Service provides one-click unsubscribe on every message), and for the content of the notifications you send. SMS notifications additionally require the recipient’s consent to receive messages at that number.

11. Availability and support

A status page exists to work during an outage, and we build accordingly: your public page is pre-rendered and served from object storage behind a CDN, with no database on the request path. We target 99.9% monthly availability for the public status-page surface and 99.5% for the dashboard and API, excluding announced maintenance and events outside our reasonable control.

These targets are objectives, not a warranty, unless you are on a plan or written agreement that includes a service level agreement with credits. Support is provided by email at support@isitstillup.com on business days, with priority given to paid plans and to incidents affecting page availability.

12. Third-party services and dependencies

Operating the Service involves third parties: cloud hosting and object storage, a CDN and DNS provider, an email sending provider, an SMS provider, our payment provider Paddle, and — for the optional AI features — an AI model provider. They are listed by name in our Privacy Policy. We choose them carefully and remain responsible to you for their processing of your data, but we are not responsible for the availability of third-party systems you connect to yourself, such as your Slack, Teams or Discord workspace or the endpoints you ask us to monitor.

13. Intellectual property

The Service — its software, design, documentation, the IsItStillUp name and logo, and everything else we provide apart from Customer Content — is owned by Nancy Sahu or its licensors and protected by intellectual property law. Subject to these terms and to payment of the applicable fees, we grant you a non-exclusive, non-transferable, revocable right to use the Service for your own business purposes during your subscription. No other rights are granted.

You grant us the right to use your organisation and page name and logo solely to render your status pages and notifications. If you send us feedback or suggestions, we may use them to improve the Service without obligation or payment to you; feedback is not confidential.

14. Disclaimers

Except as expressly stated in these terms, and to the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted or error-free.

In particular: monitoring is a best-effort signal, not a guarantee that we will detect every outage or that every alert is accurate; AI-assisted drafts are suggestions that a human in your organisation must review before publishing; and IsItStillUp is not a substitute for your own incident response, backups or observability.

Nothing in these terms excludes or limits any warranty, right or remedy that cannot lawfully be excluded, including the statutory rights of consumers.

15. Limitation of liability

To the fullest extent permitted by law, neither party is liable to the other for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, goodwill, business or data, however caused and under any theory of liability.

Our total aggregate liability arising out of or relating to the Service and these terms is limited to the total amount of fees you actually paid for the Service in the twelve (12) months immediately before the event giving rise to the claim. Where you use the Service on the Free plan, that amount is zero and our liability is limited to USD 50.

These limits do not apply to liability that cannot be limited by law — including death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or a party’s liability for its own wilful misconduct — and they do not affect the statutory rights of consumers, which remain in full.

16. Suspension and termination

You may stop using the Service and delete your organisation at any time from the dashboard. We may suspend or terminate your access if you materially breach these terms (including clause 5) and do not fix the breach within 14 days of our notice, if payment for a paid plan remains outstanding, or if we are required to do so by law.

On termination, your subscription ends and your public pages stop being served. We keep your data for 30 days so you can export it or reactivate, then delete it from our production systems, with backups ageing out within a further 30 days. If you ask us to erase it sooner, we will (see the Privacy Policy). Clauses that by their nature should survive termination — content ownership, intellectual property, disclaimers, liability, governing law — do.

17. Changes to these terms

We may update these terms as the Service and the law evolve. For material changes we will give notice by email to organisation owners, or by a notice in the dashboard, at least 30 days before they take effect. The “Last updated” date at the top of this page always reflects the current version. Continuing to use the Service after a change takes effect means you accept the updated terms; if you don’t, cancel before then.

18. Governing law and disputes

These terms and any dispute arising out of them are governed by the laws of India, and the courts of India have exclusive jurisdiction — except that, if you are a consumer resident elsewhere, you keep the benefit of any mandatory consumer-protection rules of your country of residence and may bring proceedings there.

Before starting formal proceedings, please contact us at support@isitstillup.com; most disputes are resolved faster by email than by lawyers.

19. General

  • Entire agreement. These terms, the Privacy Policy and the Refund Policy are the whole agreement between us about the Service, and replace any earlier understanding.
  • Assignment. You may not assign this agreement without our written consent. We may assign it to a successor in connection with a merger, acquisition or sale of assets, on notice to you.
  • Severability and waiver. If a provision is found unenforceable, the rest stands. A failure to enforce a right is not a waiver of it.
  • Force majeure. Neither party is liable for a delay or failure caused by events beyond its reasonable control.
  • Notices. We send notices to the email address on your account; you send them to support@isitstillup.com. Notices are treated as received on the next business day.
  • No partnership. Nothing here creates a partnership, agency or employment relationship between us.
